Four arrested, three child care centers charged in million dollar fraud case

Search warrants were executed at four child care centers and four people were taken into custody Tuesday as part of an extensive investigation into fraudulent billing of the Child Care Assistance Program that is likely to surpass $1 million.

In addition to the search warrants, the Hennepin County Attorney’s Office filed charges against three of the centers and froze $219,000 in the day-care centers’ bank accounts. The three centers are Minnesota Child Care Service, Inc., 2500 Minnehaha Ave.; Children’s Choice Center, Inc., 2700 Summer St. NE and Ummah Child Care Services, Inc., 2505 Fifth Ave. S, all in Minneapolis. The Minnesota Childcare Academy, Inc. of St. Louis Park was searched but no charges were filed against it Tuesday.

The individuals arrested are: Saeed Jama BihiI, 47, of Minneapolis; Ahmed Abdi Sharmarke, 22, of Woodbury; Hamdi Ahmed Nur 24, of Minneapolis; and Ibrahim Awgab Osman, 53, of New Hope.

The investigation is continuing and charges against Minnesota Childcare Academy and against individuals owning or working at all four centers are likely in the future, Hennepin County Attorney Mike Freeman said.

The investigation, Operation Kids Count, began about 18 months ago when the Minnesota Department of Human Services’ Office of Inspector General noticed unusually large billings from Minnesota Child Care Services to the Child Care Assistance Program. That department soon asked the Minnesota Bureau of Criminal Apprehension to lead the investigation.

"Each of the child care facilities charged have been involved in a common theme of billing the government for child care services and then not providing them. These centers do provide legitimate support and services, but they also bill the government anywhere from 15-30% for kids who weren't there," said Freeman at a news conference held at the Hennepin County Government Center. "If there were 200 kids in the center, they would bill the government for 300. This common scheme was discovered by the Inspector General's Office. It is upsetting because basically they took money from us taxpayers and these individuals who ran the child care centers put the money in their own pockets. More importantly, these dollars are designed for child care and there are a lot of kids on a waiting list because these people were ripping the government off;"

Inspector General Jerry Kerber said that about 30,000 Minnesota children each month are helped by the Child Care Assistance Program and that another 5,300 children are on a waiting list. "We have individuals helping themselves to the money that';s supposed to be helping families and children,"said Kerber. 'The children are the primary victims."

Wade Setter, Superintendent of the Minnesota. Bureau of Criminal Apprehension, said "In terms of dollars, this is the largest criminal fraud investigation the BCA has worked in its partnership with DHS. This kind of criminal activity victimizes every Minnesota taxpayer, but particularly those who need affordable child care. Our work to identify and investigate those who would commit fraud of this nature will continue."

The assistance program is designed to provide low-income families with subsidies so that their child care will be free or very low cost so the parents can work. The assistance program makes up the difference to the child care centers. Funding for the program comes from federal, state and county taxes. In 2014, the child care centers throughout Minnesota received approximately $215 million from the assistance program.

According to the criminal complaint, investigators became suspicious about how much money the four centers were billing to the state. So they obtained warrants and installed hidden cameras that could view the entrances to the child care centers. Agents also conducted numerous hours of surveillance and then watched the video and counted the number of children entering it.

After checking the billings to the state for the same time period, they found that the centers were claiming many more children were attending the child care centers than were actually present. For instance, in a two-week billing cycle in late November into early December, Minnesota Child Care Services claimed 2,183 had attended and the center should be paid for them. A review of the video, however, found that no more than 1,233 children actually attended, or a difference of 950 children. That would mean about one-third of the company';s billing to the state was for phantom children, the complaint states.

The money was used for the benefit of the company and its owners, according to the complaint.

First appearances for the three companies is set for Oct. 28 at 1:30 p.m.

In addition to the BCA and Department of Human Services investigators, about 70 people helped with the investigation and execution of the search warrants from the following law enforcement agencies: U.S. Dept. of Homeland Security-Homeland Security Investigations; U.S. Dept. of Health & Human Services-OIG; FBI; U.S. Postal Inspection Service; Hennepin County Sheriff’s Dept.; Hennepin County Human Services Fraud Investigation Unit; Minneapolis Police Dept.; St Louis Park Police Dept.; New Hope Police Dept.; Anoka County Sheriff’s Dept.; Anoka County Attorney’s Office; Ramsey County Sheriff’s Dept.New Brighton Police Dept.; Washington County Sheriff’s Dept. and Woodbury Police.
