Hennepin County Attorney’s Office files opposition to Gregory Morgan’s motion for removal to federal court

The Hennepin County Attorney’s Office filed its opposition Wednesday to ICE agent Gregory Morgan’s motion to move his case to federal court.

Mr. Morgan was charged with two counts of second-degree assault for an incident in February where he brandished and pointed his duty weapon at two individuals while traveling alongside them in a black rental vehicle.

“The defense’s filing asking to move this case to federal court last week was expected, and today we’ve filed our response,” Hennepin County Attorney Mary Moriarty said. “Mr. Morgan’s actions were unlawful and in violation of Minnesota law. Regardless of whether we end up in federal or state court, our office is prepared to prosecute this case."

The federal judge could deny Mr. Morgan’s motion and send the case back to state court, or schedule a hearing for the parties to argue their positions. Should the case be removed to federal court, it will still be prosecuted by Hennepin County prosecutors under Minnesota law.
