Hennepin County Attorney’s Office completes review of officer-involved shooting, finds Minneapolis Police acted lawfully

The Hennepin County Attorney’s Office has completed its review of the officer-involved shooting incident that occurred after Minneapolis Police Officer Jamal Mitchell was shot and killed on May 30, 2024.
The Minnesota Bureau of Criminal Apprehension (BCA) conducted a thorough investigation and provided the case file to the Hennepin County Attorney’s Office for review, as is standard practice.
On May 30, 2024, Mustafa Mohamed shot and killed Mohamed Aden and Osman Jimale inside an apartment complex and, after exiting the building, he tried to forcibly steal an electric scooter. A passerby witnessed this robbery in progress and attempted to intervene while still in his vehicle, which struck Mr. Mohamed and broke his femur. While Mr. Mohamed was on the ground and injured, he shot and wounded a passerby who had stopped to render aid. Officer Mitchell was the first responding officer on scene and when he arrived, both Mr. Mohamed and the passerby he shot were lying in the street. Officer Mitchell approached to render aid and was shot and killed by Mustafa Mohamed. Two other police officers who responded to the scene used deadly force, killing Mustafa Mohamed.
Due to the death of Mustafa Mohamed, no charges were considered related to the deaths and injuries he caused. The only remaining legal analysis was whether the use of force by MPD officers against Mustafa Mohamed was lawful.
After review, the HCAO has determined that the use of deadly force by Minneapolis Police was appropriate and in conformance with the law. No criminal charges are appropriate in this matter.
“This was a horrific incident that scarred our community,” Hennepin County Attorney Mary Moriarty said. “All of our thoughts are with the loved ones of Officer Mitchell, who was killed as he tried to provide aid, along with the families of Mohamed Aden and Osman Jimale. I’m grateful to all those who took action to help that day, including the Minneapolis Police officers who acted quickly to stop Mr. Mohamed from hurting anyone else, the Minneapolis Firefighters who immediately responded to render aid, and the community member who attempted to help and was shot. I also want to thank the BCA for their thorough investigation of this matter, and our staff for their review of this complex case.”
While the goals of both the BCA and the HCAO are to conclude their investigation and review within 60 days for each stage, the large volume of evidence across multiple crime scenes made meeting those aspirational goals impossible.
