Federal court judge orders new schedule for Hennepin County Attorney’s Office, State of Minnesota lawsuit regarding access to evidence

The Honorable Judge Emmet G. Sullivan issued an order Thursday in the civil case filed in U.S. District Court by (1) the Hennepin County Attorney’s Office (HCAO), (2) the State of Minnesota, by and through Minnesota Attorney General Keith Ellison, and (3) the Minnesota Bureau of Criminal Apprehension.

The order sets a schedule for the next sequence of events in the lawsuit to gain access to evidence in the Renee Good, and Alex Pretti killings and the shooting of Julio Sosa-Celis.

The HCAO and State of Minnesota preserved their position that DOJ/DHS have already made decisions that constitute final agency action.

June 4, 2026

  • DOJ/DHS will provide final written responses to the submitted Touhy requests.

June 18, 2026

  • HCAO/State will amend its lawsuit to address the written Touhy responses.

June 25, 2026

  • HCAO/State will file a Motion for Summary Judgment. DOJ/DHS will also file a Motion to Dismiss.

“Today’s order is a major step forward in this lawsuit, advancing our goal of getting access to the evidence that the federal government has withheld,” Hennepin County Attorney Mary Moriarty said. “We can now move expeditiously to continue to seek accountability for the shooting of Julio Sosa-Celis and the deaths of Renee Good and Alex Pretti.”

"Three Minnesotans were shot and two of them were killed by federal agents. We cannot allow the federal government to conceal the evidence surrounding those shootings, and we now have a path forward in our fight for transparency and accountability," said Attorney General Ellison. "We will continue to conduct fair, thorough, and impartial investigations and to follow the facts wherever they lead because the rule of law demands it and because Renee Good, Alex Pretti, and Julio Sosa-Celis deserve it."
